Terms of Service

These Terms are an agreement between you and Jason Brown, an individual doing business as Architect ("Architect", "we", "us"). They cover the Architect website, web app and any related apps (the "Service").
1. Accepting these Terms
By creating an account, ticking the box at sign-up or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service. If you are under 18, your parent or guardian also agrees to these Terms and is responsible for your use.
2. Who can use Architect
- You must be at least 13 years old to use Architect. Architect is not meant for children under 13, and we don't knowingly collect information from them. If we learn an account belongs to someone under 13, we will delete it and its data.
- If you are under 18, a parent or legal guardian must agree to these Terms with you.
- You may not use Architect if you are barred from doing so by law, or if we have closed your account before.
3. Your account
- You sign in with a Google account. Keep that account secure; anything done through your sign-in is your responsibility.
- One person per account. Don't share your sign-in or use someone else's.
- Tell us right away at support@architect.do if you think your account has been misused.
4. Acceptable use
You agree to use Architect only for lawful purposes. You will not:
- break any law, or help anyone else break one;
- store or share content that is illegal, infringes someone else's rights, or harasses, threatens or exploits anyone, especially a minor;
- send spam or unwanted invitations through the sharing features;
- try to get into accounts or data that aren't yours, or probe, scan or test the Service's security;
- upload viruses or harmful code, or overload or disrupt the Service;
- copy, resell, reverse-engineer, or scrape the Service, or use automated tools to access it except through features we provide;
- use Architect to build a competing product.
We may remove content or suspend accounts that break these rules.
5. Sensitive information
Architect is a personal planner. It is not built or certified to hold regulated or highly sensitive data, and you agree not to store it there. That includes:
- health records or protected health information governed by HIPAA or similar laws, such as medical records, diagnoses, or anyone else's health information you handle for work. Personal goals and habits ("walk 8,000 steps", "lose 30 pounds") are fine;
- financial account details: bank account, credit or debit card numbers, or account passwords;
- government ID numbers, such as Social Security, passport or driver's license numbers;
- passwords or security codes for any service;
- other people's sensitive personal information without their permission.
Architect does not offer HIPAA business associate agreements and is not PCI compliant. If you store this kind of information anyway, you do so at your own risk, and we are not responsible for its loss or exposure.
6. Your content
- You own what you put in Architect: tasks, notes, habits, visions and everything else ("Your Content").
- You give us permission to store, copy, process and display Your Content only as needed to run, secure and improve the Service for you, and to show it to people you choose to share it with.
- You are responsible for Your Content and confirm you have the right to store and share it.
- You can export your data and delete your account at any time.
7. Sharing with other people
- When you share something, the people you invite can see it and act on it according to the role and permissions you give them. They may copy it if you allow copying.
- You are responsible for what you share and with whom. We are not responsible for what other users do with content you share with them.
- Content others share with you belongs to them. Use it only as they allow.
8. Google and other services
- Architect connects to services we don't control, including Google sign-in, Google Calendar and Google Tasks, and our hosting and database providers. Your use of those services is also governed by their own terms.
- Architect reads and changes your Google data only as you direct, and only to provide the features you use. Our use of data received from Google follows the Google API Services User Data Policy, including its Limited Use requirements.
- We aren't responsible for outages, changes or data loss caused by those services.
9. AI features
Some features may use artificial intelligence to suggest plans, summarize or answer questions. AI output can be wrong, incomplete or out of date. Check it before relying on it. You are responsible for what you decide to do.
10. Not professional advice
Architect, including its coach and AI features, is a planning tool. Nothing in it is medical, health, fitness, mental-health, financial, legal or other professional advice. Talk to a qualified professional before starting a diet, exercise or health program, or making financial or legal decisions. If you're in a crisis, contact local emergency services.
Health and fitness goals. You may track personal health and fitness goals in Architect, such as weight, exercise, sleep or diet. You are solely responsible for those goals and how you pursue them. Any suggestion, plan, reminder, score or encouragement from Architect, its coach or its AI features is general information only, not medical guidance. Consult a doctor or other qualified health professional before starting or changing any diet, exercise, weight-loss or health program, and stop and seek medical help if you feel unwell. We are not liable for any injury, illness or other harm connected to your health goals or to any guidance the Service provides about them.
11. No guarantee of performance
- Architect is in early access. Features may change, break, move or be removed without notice.
- We don't promise that the Service will be available at any particular time, will be free of errors, or will keep your data forever.
- Reminders, notifications and sync may be late or may not arrive at all. Don't rely on Architect for anything where a missed reminder could cause harm, such as medication, safety or legal deadlines.
- Keep your own copies of anything important. You can export your data at any time.
12. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY. THIS INCLUDES ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OR ERROR-FREE OPERATION, TO THE FULLEST EXTENT THE LAW ALLOWS. Some places don't allow these exclusions, so some may not apply to you.
13. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS:
- WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, MISSED DEADLINES OR APPOINTMENTS, OR LOSS OF GOODWILL, EVEN IF WE WERE TOLD THEY WERE POSSIBLE;
- OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR US$50.
14. Indemnity
You agree to defend and hold us harmless from claims, losses and costs (including reasonable legal fees) that come from Your Content, your use of the Service, or your breaking these Terms or the law.
15. Fees
Architect is free during early access. If we add paid plans, we'll tell you before anything is charged, and you won't be charged unless you choose a paid plan. Core planning and reminders stay free.
16. Ending your account
- You can stop using Architect and delete your account at any time.
- We may suspend or close your account if you break these Terms, if your use creates risk or legal exposure for us or others, or if we stop offering the Service. Where reasonable, we'll give notice and a chance to export your data.
- Sections 5, 6 (your responsibility for Your Content), 10 and 12 through 19 continue after your account ends.
17. Changes to these Terms
We may update these Terms. For changes that matter, we'll notify you in the app or by email and ask you to accept them on your next sign-in. If you don't agree, stop using the Service and you may delete your account.
18. Governing law and disputes
These Terms are governed by the laws of the State of Utah, USA, without regard to conflict-of-law rules. Before filing any claim, you agree to contact us at support@architect.do and try to resolve it informally for 30 days. Any dispute that isn't resolved will be heard in the state or federal courts in Utah, and you consent to their jurisdiction. Either party may bring a claim in small-claims court if it qualifies.
19. Privacy and everything else
- Our Privacy Policy explains what we collect and how we use it, and is part of these Terms.
- If any part of these Terms is found unenforceable, the rest still applies.
- If we don't enforce a term right away, we haven't waived it.
- You may not transfer these Terms to anyone else. We may transfer them if the Service changes hands.
- These Terms and the Privacy Policy are the whole agreement between us about the Service.
